Introduction

Dagda Public Loss Assessors Ltd trading as Pro Insurance Claims (“Pro Insurance Claims”, “we”, “us”, “our”) is an independent firm of Loss Assessors.

We do not act on behalf of insurance companies or insurance brokers. Our role is to represent and assist you, the policyholder, throughout the insurance claims process.

Our initial task is to assess whether your loss is covered under the terms of your insurance policy. Where cover is confirmed, you may appoint us to act on your behalf in assessing, quantifying, preparing, and negotiating your claim with the insurer and their appointed representatives.

These Terms of Business outline important information relating to our services and the claims process. Please read them carefully and contact us if you require clarification on any aspect before engaging our services.

Consumer Protection

Dagda Public Loss Assessors Ltd trading as Pro Insurance Claims is subject to the provisions of the Consumer Protection Code 2012.

Data Protection

We may collect and process personal information for the purpose of handling and managing your insurance claim.

Your information may also be used for:

  • Internal management and administration purposes
  • Statistical analysis relating to claims activity
  • Future communication where appropriate

We are committed to handling personal data in accordance with applicable data protection legislation.

Conflicts of Interest

We endeavour at all times to avoid conflicts of interest and maintain systems and procedures designed to identify and resolve any such issues promptly.

Should a conflict arise, we will communicate with you immediately and seek to resolve the matter appropriately.

If you believe a conflict of interest exists in relation to your claim, you should contact us directly without delay.

Complaints Procedure

We take complaints seriously and are committed to addressing concerns promptly and professionally.

Complaints will be investigated and acknowledged within five business days, with a written response outlining our findings.

Claims Process

Our role typically includes:

  • Reviewing your insurance policy and advising on cover
  • Inspecting and assessing the loss
  • Preparing and submitting the claim
  • Liaising with insurers and their appointed Loss Adjusters
  • Negotiating settlement proposals on your behalf

Any settlement proposals received will be discussed with you before agreement is reached.

Fees

Our standard fee is:

10% + VAT of the Overall Settlement Amount

Alternative fee arrangements may be agreed separately in writing.

Fees become payable once the insurance claim has been agreed and settled.

Invoices must be paid in full within seven days of receipt of the initial payment from insurers.

Important Fee Information

Please note:

  • Our fees are not ordinarily covered by your insurance policy
  • We are not paid by your insurance company
  • Fees apply regardless of whether settlement is agreed directly by the insured or through our involvement
  • Additional work associated with certain settlement structures may attract further agreed fees where applicable

Claim Payments & Retentions

Insurance settlements may include:

  • Policy excess deductions
  • Retention amounts held back pending completion of reinstatement works

Retention funds are typically released once works are completed and supporting documentation (e.g. invoices, receipts, photographs) has been provided to the insurer.


Responsibilities of the Policyholder

The policyholder remains responsible for:

  • Ensuring the accuracy and validity of invoices and receipts
  • Properly engaging contractors and professionals involved in reinstatement works
  • Maintaining documentary evidence relating to expenditure and repairs

Pro Insurance Claims is responsible for managing the insurance claim process only and does not supervise or assume responsibility for reinstatement works carried out by third parties.


Delays & Insurer Decisions

While we actively manage and progress claims on behalf of our clients, we are not responsible for delays, inaction, or decisions made by insurance companies or their appointed representatives.


Retention Applications

Applications for release of retention monies will only be processed once all outstanding fees due to Pro Insurance Claims have been paid in full.


Defaults & Outstanding Fees

Where fees remain unpaid beyond seven days following receipt of settlement monies, we reserve the right to refer the matter to debt collection agents or legal representatives.

Any associated recovery costs may become payable by the policyholder and may affect creditworthiness.


No Claims Bonus

Please note that property insurance claims may affect any no claims bonus applicable to your insurance policy.

Acceptance of Terms

By engaging Pro Insurance Claims, you acknowledge that you have read and understood these Terms of Business and agree to the basis upon which services are provided.
